Three senior officials avoid conflicts of interest

PRISHTINA, 31 January 2012 - Anti Corruption Agency has closed an investigation against Besnik Berisha, Director of Department for the Production of Documents at MIA, Faik Fazliu, Advisor to the Office of Prime Minister and Shefqet Ukaj, Deputy Mayor of Peja, since all three senior public officials have avoided the conflict of interest situation in which they were. 
ACA had started the procedure of handling the situation of conflict of interest in exercising the public function of Mr. Besnik Berisha, Director of Department for the Production of Documents at the Ministry of Internal Affairs, who alongside with his function in a private business where he had been the owner was the authorized person in two businesses "N.SH. Festina" and "N.SH.Festina", which represented a potential conflict of interest. After the conducted procedure, the senior official brought evidence that he had made the required changes in business and acted according to the procedures. Thus, according to ACA, Mr. Berisha has avoided the conflict of interest situation in which he was.
In the other case of Mr. Faik Fazliu, Political Advisor to the Office of the Prime Minister, the Agency has determined that he was in conflict of interest because he was a senior public official and at the same time he was the owner and the authorized person in a private business, "FENIKS GROUP" SH.P.K. According to the Law on Prevention of Conflict of Interest in Exercising Public Function no. 04/L-051, this presented a conflict of interest.
Anti-Corruption Agency through the notification document requested the official Mr. Faik Fazliu to avoid potential conflict of interest. After the conducted procedure, Mr. Fazliu brought the documentation that proves that he has made changes in the business as required by the law.
Also, in the case of Mr. Shefqet Ukaj, Deputy Mayor of Peja, were conducted all procedures and the case was treated to have elements of potential conflict of interest in the exercise of public function, where Mr. Ukaj was at the same time the owner and authorized person in the private ambulance "Dr. Shefqeti "in Peja, which represented a conflict of interest.
During the proceedings Mr. Shefqet Ukaj has been asked to avoid this situation, since it represented a potential conflict of interest and in accordance to the legal procedures, Mr. Ukaj has cooperated with the Agency and brought the documentation that proves that he has made changes requested by the Agency and it was concluded that the senior public official has avoided conflict of interest situation in which he was.
According to the Law on Prevention of Conflict of Interest, Anti-Corruption Agency is obliged to make public all decisions taken in terms of cases that are in conflict of interest, cases that avoid conflict of interest as well as cases where officials do not avoid conflict of interest and those that ACA is obliged to address to the prosecutor for violations.
